This is a little troublesome: Capitol Records won a ruling against a classical label, Naxos, issued sessions made in the UK for The Gramophone Co in the 1930s that had fallen out of copyright, but that were determined to be still covered by common law. I am of two minds on the issue generally. It’s strange to see Elvis lapsing into the public domain in Europe. On the other hand, Elvis hasn’t been around to enjoy the fruits of his labours for a while, either.
Of course, the original bootleg records were illegal repressings of 78s that had gone out of print… EMI could just be licensing everything in their libraries and everyone would be happy.
